PRIVACY AND PERSONAL INFORMATION PROTECTION POLICY

As an acupuncturist, I ensure the confidentiality of personal information, regardless of its nature or form, and regardless of the third parties I engage with for my professional activities.
This privacy policy outlines how I protect the personal information I hold to comply with applicable privacy laws, including those of the Ordre des Acupuncteurs du Québec, as well as other relevant laws and regulations.
This Policy does not apply to information that is publicly available under these laws.

Responsibility

As an acupuncturist and independent worker, I am responsible for protecting the personal information entrusted to me, as well as ensuring that any third parties I engage with also protect the confidentiality of personal information they have access to.

I. Under the Regulation on Record Keeping and Consultation Cabinets of the Ordre des Acupuncteurs du Québec, an acupuncturist must create and maintain a file for each person who consults them. It must contain the following information:
1° Date of file opening.
2° Identity of the person consulting, including name, gender, date of birth, address, phone number, and email.
3° Observations following the interrogation and clinical examination of the person.
4° Opinion regarding the nature of the illness, according to oriental energy medicine.

The file must also include:
1° Date of consultation.
2° Treatment indication.
3° Identification of acupuncture sites using international nomenclature (Beijing) or Chinese character romanization (Pinyin), types, and methods of stimulation.
4° Description of professional services rendered and any favorable or adverse reactions to treatment.
5° Type of needles or instruments used and the technique employed.
6° List of known diagnoses and any medication taken by the person, including corticosteroids or anticoagulants.
7° Reports of consultations with a physician or other professional.
8° Any other document related to the person’s illness.
9° Legal authorizations such as disclosure to third parties or withdrawal of certain documents.
10° Any other document indicating recommendations, terms, or special agreements.

The acupuncturist must keep each file up to date until they cease to provide professional services to the person concerned by the file.
The acupuncturist must retain each file for at least 5 years from the date of the last service provided.

II. Who can access your information:
You or your legal representative
Anyone authorized by law to access this information
Anyone you have specifically authorized in writing to access the information in your file

III. An acupuncturist who uses a medium other than paper for keeping and storing all or part of the information, documents, and elements related to a patient’s file must:
1° Save the collected data and keep a copy of this backup.
2° Use a database separate from any other for keeping records under this section.
3° Protect access to this data, including using a password.

Through up-to-date software in which the automatic filling of the identifier field and password giving access to information is deactivated at all times, accesses are interrupted after a short period of inactivity, and no advertising is displayed.
By destroying (or anonymizing for later use for serious and legitimate purposes) information about a patient, 5 years after its collection.

Purpose of collection and means by which I collect personal information

I only use the personal information collected to achieve the following objectives:
Identification, in accordance with OAQ requests
Communicate with you
Promotional purposes, teaching about acupuncture, or sharing clinic-related information
Customize/improve navigation on my website
For payment of treatments received for accounting reconciliation

I collect your personal information through:
File opening form – paper, or electronic with Jane App
Online record-keeping software on Jane App: servers are located in Quebec territory.
Social networks: Professional Facebook page
Google business listing
Payment terminal

Consent – Collection, use, and disclosure

I seek your informed consent before collecting, using, or disclosing your personal information to third parties, except as provided by law.
Under no circumstances will I use or disclose personal information without your consent unless authorized or required to do so by applicable legislation.

Retention period

To comply with the Acupuncture Act, I keep your personal information for a period of 5 years following their last use unless the law provides for a different retention period.

Security measures

I protect your personal information with appropriate security measures (physical, technical, or administrative) tailored to their nature, to prevent unauthorized access, use, or disclosure, or to prevent loss or any other harm to their protection.

Access and correction of your personal information

It is important that the personal information I hold about you is up to date. Please inform me of any changes to it. Additionally, you can submit a request:
